The UK government has specified four groups of people who do not need to meet the English language requirement when applying for settlement. These exemptions are based on age, disability, and residency.

Applicants 65 years or older, and those under 18, are automatically exempt from the English language requirement. Individuals with a physical or mental disability that prevents them from meeting the language condition are also exempt.

The fourth category applies to partners, parents, or dependent children aged over 18 who have spent 15 continuous years in the UK with valid permission. They must hold an A2 level qualification or equivalent, and a teacher's assessment is required.

A change in the assessment threshold is set for 26 March 2027, when the teacher must confirm that the applicant is unlikely to reach the higher B2 level of English proficiency. Previously, the threshold was the B1 level.

The UK has also listed 19 countries whose citizens are not required to sit an English language test when applying for a student visa. These countries include the US, Australia, and New Zealand, but no African nations are included.

Additionally, the UK has outlined countries whose university graduates may be exempt from taking a formal English language test. These countries include the UK, US, Australia, and New Zealand, but Canada is explicitly excluded from this exemption.

The UK government has also released a list of approved Secure English Language Test providers for foreign nationals applying for visas.

The English language exemptions and test providers are outlined in the UK Immigration Rules.

Three perspectives

Neutral

The UK government's changes to English language requirements aim to simplify the application process for certain groups. The new rules may affect the number of applicants for settlement and student visas. Further details on the application process are available on the UK government's website.

Positive

The exemptions and changes to English language requirements may make it easier for certain individuals to apply for settlement and student visas in the UK. This could lead to an increase in international students and skilled workers in the country.

Negative

The exclusion of African nations from the list of countries exempt from English language tests for student visas may be seen as unfair. The changes to the assessment threshold may also make it more difficult for some applicants to meet the language requirement.
